Fighting for Justice: Challenging the NFL Disability Plan’s Unfair Practices
Alford et al. v. The NFL Player Disability & Survivor Benefit Plan et al. was filed to challenge breaches of fiduciary duties by the defendants, as well as separately the wrong denial of benefits, for former NFL players. The lawsuit aims to hold the defendants accountable for its biased practices, which have infected the Board’s decision-making and harmed the integrity of the ERISA-regulated claims process. In addition, the wrongful denial of benefits has left many disabled players without the financial support they deserve.
Our team has been a driving force behind this litigation, applying nearly a decade of ERISA expertise and direct representation of hundreds of players. Our contributions include:
- Architecting the Case: Athlaw LLP played a key role in building the legal foundation of the class action, leveraging our unique institutional knowledge of the NFL Plan and its operations.
- Challenging Bias: Through extensive factual and legal research, we’ve exposed statistical patterns of discrimination, bias, and conflicts of interest, strengthening the case for all affected players.
- Relentless Representation: From drafting the Amended Complaint to the bulk of the response to the Motion to Dismiss, our team has worked tirelessly on complaint preparation, legal research, and persuasive briefing, ensuring that the voices of former NFL players are heard.
We continue to tirelessly pursue this class action case.
